1. Acceptance of Terms

Welcome to AI Fruit Videos ("AI Fruit", "we", "us" or "our"). These Terms of Service ("Terms") govern your access to and use of our AI-powered video generation service available at https://aifruitvideos.net (the "Service").

The Service is operated by 向雄 (Xiangxiong), an individual seller based in Shenzhen, China.

By creating an account, subscribing to a plan, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood and agree to be bound by these Terms; (c) agree to our Privacy Policy at https://aifruitvideos.net/privacy-policy; and (d) are authorised to enter into this agreement on behalf of yourself or any organisation you represent.

⚠️ Important: If you do not agree to these Terms, you must not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

2. Description of the Service

2.1 What we provide. AI Fruit provides an AI-powered platform that lets you generate short fruit-themed ASMR, mukbang and other creative videos from text prompts and reference images, together with related editing, download and account features. The Service is a digital software-as-a-service (SaaS) product delivered over the internet.

2.2 Nature of the Service. The Service is a digital intangible product. Access is granted as soon as payment is confirmed. Because of the immediate delivery of digital services, refunds are subject to the specific limits in our Refund Policy (Section 7).

2.3 Third-party AI models. The Service uses third-party AI model providers, including Replicate, Fal and KIE, and the models they host (such as Veo 3.1, Sora 2, Wan Pro and Kling O1). Their operating status can affect the performance and availability of the Service. We will notify users of material outages where reasonably practicable. Output may vary between models and may be affected by changes those providers make.

3. Accounts

3.1 Account creation. You must create an account with accurate, complete and current information to use the Service. You are responsible for keeping your login credentials confidential and for all activity under your account.

3.2 Account security. If you discover unauthorised use of your account, contact xx0903041@gmail.com immediately. Do not share your login credentials with any third party. Keep your billing email address current.

3.3 Business accounts. If you register on behalf of a company or organisation, you represent that you are authorised to enter into this agreement for that entity.

4. Plans and Credits

4.1 Subscriptions. We offer Creator and Pro subscription plans, billed monthly or yearly, each with a credit allocation and feature access. Current plans, prices and credit allocations are shown at https://aifruitvideos.net/pricing.

4.2 Credit packs. We also offer one-time credit packs that can be purchased without a subscription. Credit packs are one-time purchases and do not renew.

4.3 How credits work. Generation consumes credits at the cost displayed in the editor before you submit a task. Costs vary with the model, duration and resolution you select. Credits are reserved when a task starts and returned if generation fails on our side.

4.4 Expiry. Credits included in a subscription plan expire at the end of the current billing period and do not roll over. Credits purchased as a one-time pack remain valid for 365 days from the date of purchase.

4.5 Consumption order. Credits are consumed in order of earliest expiration. Credits have no cash value, are non-transferable and cannot be exchanged for cash.

4.6 Changes to plans. We may change plan features or introduce new plans. Price changes are governed by Section 5.4.

5. Billing and Payment

5.1 Automatic renewal authorisation. When you subscribe to a paid plan and provide a payment method, you expressly authorise us to charge that payment method for the subscription fee on a recurring basis, in the amount and at the interval shown at checkout. This authorisation remains in effect until you cancel under Section 6.

Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. You may cancel at any time to avoid the next charge.

5.2 Payment processing. Payments are processed by our payment processor, Waffo Pancake ("Waffo"). Payment card details are handled exclusively by Waffo and are not stored on our servers. Waffo maintains PCI-DSS compliance for card processing.

5.3 Taxes. Prices are exclusive of applicable taxes (including VAT, GST and sales tax) unless stated otherwise. Where required by law, we will collect and remit such taxes.

5.4 Price changes. We may change subscription prices. We will give you at least 14 days' notice before a price change takes effect for your plan, and any change applies from your next renewal. If you do not agree, you may cancel before the change takes effect.

6. Cancellation

6.1 How to cancel. You can cancel at any time by:

  • Your subscription remains active until the end of the current billing period.

  • You will not be charged for any further billing period.

  • Separately purchased credit-pack credits are not cancelled and remain valid until their original expiry date, subject to these Terms.

  • Access to subscription-only features ends when the current billing period ends.

7. Refund Policy

7.1 Summary. Our Refund Policy at https://aifruitvideos.net/refund-policy forms part of these Terms and applies to all purchases. The key terms are summarised below; if there is any conflict, the Refund Policy controls.

7.2 Subscriptions.

  • First subscription payment: if you request a refund within 7 days of your first subscription payment and have not substantially used paid features, we will refund that payment in full.

  • Renewal payments: if you request a refund within 48 hours of a renewal charge and have not used paid features since that renewal, we will refund that renewal.

  • Otherwise, subscription payments are non-refundable and we do not give partial refunds for unused time. Your statutory rights are unaffected.

7.3 Credit packs. An unused credit pack can be refunded in full within 7 days of purchase. Once any credits from a pack have been used, that pack is non-refundable. Credits have no cash value and cannot be transferred.

7.4 Service failures. If a paid action fails because of a problem on our side, we will restore the credits used or refund the charge.

7.5 How to request a refund. Email xx0903041@gmail.com from the address you used at checkout and include your order ID or receipt. We reply within 3 business days. Approved refunds go back to the original payment method; your bank or payment provider may take 5–10 business days to show them.

7.6 Statutory rights. This policy does not limit any rights you have under the consumer law that applies to you, including any right of withdrawal (for example, the 14-day right in the EU or UK). Where digital content is supplied immediately with your prior express consent and acknowledgement that you lose the withdrawal right, that right may not apply. Nothing in this policy excludes rights that cannot lawfully be excluded.

8. Billing Disputes

If you believe a charge is wrong, email xx0903041@gmail.com before raising a transaction dispute with your bank or payment provider. We will respond within 2 business days and resolve confirmed billing errors within 5 business days.

9. AI Content and Intellectual Property

9.1 Ownership of outputs. Subject to these Terms, AI-generated content you create through the Service ("Output") is yours. You may use Output for any lawful purpose permitted by Section 10, subject to the rules of any third-party model used and any rights you need in your inputs.

9.2 Inputs. You retain ownership of prompts, reference images and other inputs you provide ("Input"). You grant us a limited, non-exclusive licence to use Input solely to operate the Service for you. We do not use your Input to train AI models without your explicit consent.

9.3 Third-party models. Output may be affected by third-party model providers. We do not guarantee a particular output and are not responsible for content generated by third-party models beyond our obligations under applicable law.

9.4 Accuracy. AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying Output before relying on it.

9.5 Platform IP. The AI Fruit platform, including its design, features and underlying technology, is owned by or licensed to us and is protected by intellectual property laws. These Terms do not transfer any platform rights to you.

10. Acceptable Use

10.1 Permitted use. You may use the Service only for lawful purposes consistent with these Terms, including personal productivity, business automation, research and development.

10.2 Prohibited uses. You agree not to use the Service to:

  • Generate illegal, defamatory, harassing or fraudulent content.

  • Generate, distribute or assist in creating deepfakes, including AI-synthesised audio, video or images that impersonate a real person or are intended to mislead viewers about their origin or authenticity.

  • Generate sexual or nude content of minors, CSAM or any content that sexualises or harms minors.

  • Create malware, phishing content or tools for network attacks.

  • Infringe any third party's intellectual property or privacy rights.

  • Bypass or interfere with the Service's security features.

  • Resell or sublicense access without our prior written approval.

  • Violate any applicable law, regulation or card scheme rule.

10.3 AI-specific prohibitions. In addition, you agree not to:

  • Use the Service's inputs, outputs, model responses or derived data to train, fine-tune, benchmark, distil or otherwise develop any AI or machine-learning model that directly or indirectly competes with the Service or AI Fruit.

  • Systematically scrape or extract model outputs at scale for any purpose beyond your authorised personal use.

  • Present AI-generated content as the work of a human professional (such as a doctor, lawyer or financial adviser) in circumstances where that could cause harm.

11. Data, Privacy and Security

Your use of the Service is subject to our Privacy Policy at https://aifruitvideos.net/privacy-policy. Payment card data is handled exclusively by our payment processor, Waffo Pancake, and is not stored on our servers. We retain account data for as long as your account is active and for a reasonable period after cancellation or deletion, in accordance with our Privacy Policy.

12. Disclaimers and Limitation of Liability

12.1 Disclaimer. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose or accuracy of AI output.

12.2 AI disclaimer. ⚠️ AI output may be inaccurate, incomplete or out of date. Do not rely on it for legal, medical, financial or other professional advice. Verify with a qualified professional before acting on AI content.

12.3 Limitation of liability. To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special or punitive damages. Our total liability arising from the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

12.4 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including your mandatory consumer rights.

13. Term and Termination

These Terms apply while you use the Service. We may suspend or terminate your account if you materially breach these Terms, if we reasonably suspect fraud, or if required by law. If we terminate for reasons other than your breach, we will refund any prepaid unused subscription amount on a pro-rata basis. You may close your account at any time by contacting xx0903041@gmail.com.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People's Republic of China. Before starting formal proceedings, please email xx0903041@gmail.com so we can try to resolve the issue informally. Subject to any mandatory consumer-protection rights that apply to you, the courts of Shenzhen, China have jurisdiction over disputes arising from these Terms or the Service.

15. General

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. If any provision is found invalid, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, Refund Policy and Acceptable Use Policy, form the entire agreement between you and us. Our failure to enforce a provision is not a waiver.
